In a recent judgment, the Supreme Court set aside an out of turn promotion given to an Engineer in Assam PWD by superseding hundreds of senior eligible engineers. The court reiterated the well settled principle that “Fraud vitiates every action and cannot be kept under the carpet on the ground that the action challenged was belated, more so when there is a reasonable explanation for such delay.”
